These general conditions (hereinafter the “General Conditions”) govern the legal relationship that arises from the contracting processes carried out between users-customers (hereinafter “Customers”) of the website www.godelia.es:

The of age user who registers, recording his/her personal data in the purchase form, after accepting the general purchase conditions.

3. Applicable law and competent jurisdiction

These General Conditions are subject to and will be governed by the laws of Spain, in particular Law 7/1998, of 13 April, on General Contracting Conditions, General Law 26/1984, of 19 July, for the Defence of Consumers and Users, and Royal Decree 1906/1999, of 17 December 1999, regulating Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of 13 December, on Personal Data Protection, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, Law 7/1996, of January 15, on Retail Trade Ordinance, and to Law 34/2002 of July 11, of Information Society and Electronic Trade Services.

The purchasing system is subject to the legislation in force in Spain. Sales will be understood to be carried out in the domicile of BODEGA Y VIÑEDOS GODELIA, S.L. Antigua Ctra. N-VI, Km. 403,5 in Pieros, Cacabelos, León, Spain.

4. Scope of the Offer and Shipping Costs

The products offered through the BODEGA Y VIÑEDOS GODELIA online shop are only distributed in Spain (mainland, the Balearic Islands, the Canary Islands, and Ceuta and Melilla). There is the possibility of shipping to other locations. Please inquire at the winery. Shipping costs for up to 17 kg to mainland Spain are €5.95 for orders under €50, except for specific promotions that may be announced. Orders over €50: free shipping. For greater weight and other destinations, please inquire.

5. Purchasing Limit

BODEGA Y VIÑEDOS GODELIA only sells to individual end customers through its online store. No purchase for resale.
Customers who are interested in making large purchases for purposes other than resale should contact Customer Service for information on available options.

Legal entities or professionals with an intra-community tax number who wish to purchase any of the products on this website should contact the Customer Service Department, which will offer them other options for making their purchase.

6. Purchasing Procedure

6.1. Selected Products

To purchase an item, select it and add it to the shopping cart by clicking on the icon.

The shopping cart will contain the selected item’s SKU, the number of items, and the price in euros. The price is after taxes but without shipping costs since rates vary.

6.2. Billing and Shipping Information

The data you entered when you registered as a user or at the time of purchase will appear on the screen as your billing and shipping information. Please feel free to change it here.

6.3. Order Confirmation and Payment

Once the purchase order has been filled in and before the order is sent, you will be shown a summary of the items you have purchased, their total price (after taxes and shipping costs), and the billing and shipping details. Confirm your order by clicking on the button ‘Confirm and proceed to payment’.

You may pay for purchases by credit or debit card (see ‘Accepted means of payment’)

Once the transaction has been confirmed, an order number will be generated and displayed.

A message with a description of the order and your personal data will also be emailed.

If, at the time the order is issued, we detect that we do not have one or more of the products included in the order in stock, the customer will be notified immediately. The refund for that product will be made within a few days.

7. Accepted Means of Payment

The BODEGA Y VIÑEDOS GODELIA only accepts payments made by credit or debit card (VISA, MASTERCARD, 4B, and IUPAY) for purchases of items in its online store.

The charge will be made online, i.e. in real time, through the payment gateway of the corresponding financial institution once it has been verified that the data provided is correct. To ensure the payment system has the maximum security, we use secure payment systems from leading financial institutions in e-commerce. Confidential payment data is encrypted and transmitted directly to the corresponding financial institution.

8. Delivery Times and Shipping Costs

Shipping for items bought at BODEGA Y VIÑEDOS GODELIA’s online store is carried out by a courier company and will be delivered within approximately three to four business days of order confirmation.

ALL ORDERS PLACED AFTER 2:00 P.M. WILL BE PROCESSED ON THE NEXT BUSINESS DAY.

The price of shipping is calculated according to the destination, the items purchased, and the packaging used to ship them. The exact shipping price will be calculated when each item is included in the shopping cart and will appear on the page summarising the purchase before the order is confirmed and before you enter your credit or debit card details.

Ask about possible shipment to post office boxes off the Spanish mainland.

9. Refunds

If you are not fully satisfied, you can return your purchases by emailing info@godelia.es. You have a maximum of 14 calendar days from placing the order to request a refund. Circumstances which may result in a refund are as follows:

• Originally defective product: once we receive the defective product we will send you another one. In this case we will replace the item or SKU with an identical item or SKU. You will only be invoiced for the first shipment. BODEGA Y VIÑEDOS GODELIA will assume the cost of the return and new shipping.
• Product other than the one ordered: BODEGA Y VIÑEDOS GODELIA will pay to return the wrong product and the shipping of the correct product.

Return conditions:

BODEGA Y VIÑEDOS GODELIA will make changes or refunds when the following conditions are met:

• Our Customer Service is notified beforehand: This step is required regardless of the reason for the return. To do so, please email info@godelia.es or call 987 54 62 79.
• Our call centre hours are from 9:00 a.m. to 6:00 p.m. from Monday to Friday.
• The products’ original seal is intact: no returns will be accepted for items whose seal has been broken in the case of wines or alcoholic beverages.
• The item to return must be properly packed for return.
• The packaging must be in perfect condition and have all its accessories in order to be returned.
• The item’s return must be by courier to the following address: BODEGAS GODELIA, S.L. Antigua Ctra. N-VI, Km. 403,5 in Pieros, Cacabelos, León, Spain.
• The cash refund will be made with the same means of payment used to pay for the order.

Please note: BODEGA Y VIÑEDOS GODELIA will not refund the purchase or reship any goods until the receipt and the condition of the packaging and accessories of the item being returned or exchanged has been verified in our warehouses. The price refunded will be the one that originally appeared in the order.

10. Customer Information

To place a purchase with us, you have to enter your personal data in the purchase form after accepting the general purchase conditions. When you place an order, your personal data, address, and data relating to your form of payment are added to our database. This information is only used to process the order and to send information about offers and services that may be of interest.

In compliance with the provisions of Organic Law 15/1999, of December 13, on Personal Data Protection, we hereby inform you that your personal data will be added to and processed in BODEGA Y VIÑEDOS GODELIA’s filing systems to process your order and to provide and offer you our services, as well as to inform you about news and offers related to them.

reserves the right to change the commercial offer in its BODEGA Y VIÑEDOS GODELIA online store (changes to products, prices, promotions, and other commercial and service conditions) at any time.

We make every effort to keep the information on the website accurate and typo-free. If at any time any error of this kind were to occur, beyond the control of BODEGA Y VIÑEDOS GODELIA, it would be corrected immediately.

If there is a typo in any of the prices shown and a customer has made a purchase decision based on that error, we will inform the customer of the error and the customer will have the right to cancel the purchase free of charge.
